I’m talking about what’s being agreed in principle and proposed as acceptable by people who are in positions of considerable power to set precedents.

I’m not talking about the law generally. I’m talking about this specific opinion. Of course the barristers would have been aware of who was instructing them and what, in an ideal world, they would want the answer to be. I’m saying that this doesn’t really change anything. Again, the opinion, from two of the highest ranking barristers in the country, found, emphatically, that the amendments were not legally binding. They would not have stuck their necks out like this if they weren’t very sure of their position. The fact that it was what the People’s Vote wanted the result to be is almost incidental and my issue with @aboynamedgoo’s original post was that it insinuates that the opinion is compromised by the fact that it was obtained by the People’s Vote. You also seem to be suggesting that it would be possible to get a legal opinion to suit an agenda by shopping around. I am saying, from experience, that this is not how it works.

Meh. Independence not being twenty points ahead in the polls right now isn’t an indication of anything.

*No, Scotland’s independent membership of the EU is not a given, but the balance of probabilities on this issue will have shifted MASSIVELY, to say the least, since 2014.

Since you ask, if I were to want to debate the point I’d suggest that this part

is not quite as simple as them being okay with a follow-up referendum under all circumstances - it’s a very specific scenario that we’re looking at that’s led them to this place, and their policy is effectively analogous to a confirmation vote rather than a second vote on the principle of Brexit.

This is also quite a big leap, as there’s a lot of other bridges to cross, like winning a majority for independence, getting legal opinions etc :wink:

I’m clinging on to this, but the current UK government will never allow a referendum and - even if they did - I can still see our electorate fucking it up.

The Wza’s saying the current UK government’s position is that they can unilaterally declare things now, so Scotland can too.

He doesn’t need to be. Leader of the the UK Labour Party, Her Majesty’s Opposition, is quite sufficient for it to be in play as benchmark and a point of debate.

It’s not really though, is it? Any more than who pays for polling or advertising or any manner of other things in politics is incidental. And, as above, they would hardly have released the opinion if it hadn’t suited their aims.

No, you don’t need to “shop around”. You go to the QCs that you already know will back your side of the argument (I gather that some QCs are even quite vocal on twitter about their opinons these days). I know, from experience, that’s exactly how it works.

Anyway, this is an impossibly dull sub-thread on an extraordinarily dull subject, so probably best to agree to disagree on this one. No hard feelings.
