Because he knew it would harm their chances of getting “back together” which is something you can only do if you were indeed ON A BREAK!!!

But if it was ok to sleep with other people whilst they were on a break it wouldn’t have been a problem. Clearly neither party considered it ok so I think it’s safe to say they were technically still together, just taking a break from actually being together.
