Is this Ofcom thing gonna affect DiS at all?

https://www.ofcom.org.uk/online-safety/illegal-and-harmful-content/time-for-tech-firms-to-act-uk-online-safety-regulation-comes-into-force/

(Another forum I use is probably going to shut down because of it :grimacing:)

(this makes it sounds like I frequent dodgy places [no, just LFGSS] which I don’t, but I think this is going to require some resources to make sure DiS complies which we (?) might not have …?)

Turns out we’ve got a North Korean flag of convenience, so none of it applies to us.

I have no idea tbh

Briefly reading it, it seems like most well-run fora self-policed themselves and brought in most of these measures years ago, without the need for legislation

The big social media sites did nothing, will probably now just do the bare minimum and all the small, community -led spaces will take the biggest hits

Like, I’m on discord servers for IPTV and piracy stuff that have more stringent posting rules than meta or twitter do

Don’t worry, the current Privacy page and Terms of Service are airtight.

I’m confused, I’m sure those transferred over from the old site. Looks like they’ve been lost in a server update.

Hrm, there’s nothing about this on the Discourse community about OfCom that I could see, would someone who is clued up about this stuff be willing to ask on there, as I think technically they are the platform, and may already have tools or a response for this

They were like that before too

I had a lawyer go over them and it wasn’t cheap, so this is is a bit confusing :face_with_diagonal_mouth:

dis isn’t any of these things, except the porno obviously, imo:

The Act places new safety duties on social media firms, search engines, messaging, gaming and dating apps, and pornography and file-sharing sites.

I think perhaps the work around would be just to turn off DMs or make them some kind tier 3 thing but not sure if that is an option - one for Discourse to look into as the platform

Ofcom is here to save us from Bartlby Scribb

If you look at the more detailed guidance on who’s covered, I think DiS is affected as a service where

people may encounter content (like images, videos, messages or comments), that has been generated, uploaded or shared by other users. Among other things, this includes private messaging, and services that allow users to upload, generate or share pornographic content. The Act calls these ‘user-to-user services’;

There’s a checker tool you can use to get some indication of whether the regulations apply

Wouldn’t this apply to every website that allows comments?!

In theory, wouldn’t any whatsapp group with more than a few users need to do this or is it covered by a blanket whatsapp agreement? Same with a Discord server? It doesn’t quite make sense

Yes, with some noted exclusions (that won’t apply in most cases).

My totally unsubstantiated guess (I’ve not looked at this in any detail) is that any action needed will be relatively minimal for sites which don’t produce or allow users to upload pornography, already have clear terms of service, and already have adequate moderation to handle violations of any relevant terms.
